Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Acts of Love ("Acts of Love," "we," "us," or "our") governing your access to and use of the Acts of Love mobile application, website, and related services (together, the "Service"). By creating an account, downloading the app, or using the Service, you agree to these Terms and to our Privacy Policy and SMS Policy. If you do not agree, do not use the Service.

The Service is distributed through the Apple App Store and Google Play. Apple Inc. and Google LLC are not parties to these Terms and are not responsible for the Service (see Section 14).

You must be at least 13 years old to create an account, and at least 18 years old to serve as a parish administrator. If you are between 13 and 18, you may use the Service only with the consent and supervision of a parent or legal guardian and with your parish's approval. The Service is intended for use in the United States.

To register, you provide your name and mobile phone number. We send a one-time passcode (OTP) by SMS to verify that the number belongs to you. This verification message is a transactional message required to create your account; it is not marketing, and it is separate from any optional alerts you choose to receive. Standard message and data rates may apply.

Accounts are reviewed and approved by an administrator of your parish community before access is granted. You agree to provide accurate information, keep your device and account credentials secure, and notify us promptly at support@actsofloveapp.com if you believe your account has been compromised. You are responsible for all activity under your account.

You agree to use the Service to build community with fellow parishioners respectfully. You will not:

• Harass, threaten, bully, defame, or harm other members;
• Post content that is unlawful, hateful, sexually explicit, violent, deceptive, or spam;
• Use another member's contact information for solicitation, marketing, fundraising outside your parish's approved activity, political campaigning, or any unauthorized purpose;
• Collect, scrape, export, or republish member directories, photos, or prayer requests;
• Impersonate another person, parish, or Acts of Love;
• Attempt to access accounts, data, or systems you are not authorized to access, or interfere with the operation or security of the Service;
• Use the Service to send unsolicited text messages, or to violate any applicable law, including the Telephone Consumer Protection Act (TCPA) or CAN-SPAM.

We may remove content and suspend or terminate accounts that violate these rules. You can report concerns in the app or by emailing support@actsofloveapp.com. We aim to review reports of objectionable content and abusive users within 24 hours and to remove violating content and, where appropriate, remove the member who provided it.

You retain ownership of the content you submit (profile details, photos, prayer requests, event and ministry information, messages). You grant Acts of Love a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display your content solely to operate and improve the Service and to display it to the community audiences you select. You represent that you have the rights to the content you post and that it does not violate these Terms or the rights of others.

Content shared with your parish community may be seen by other approved members. Please use discretion with sensitive personal information, including in prayer requests.

Parishes and organizations that use the Service designate administrators who may approve or remove members, create events and ministries, and send community notifications. Acts of Love does not control parish-level decisions or the content parishes publish. Your parish's own policies may also apply to your participation.

The Service sends transactional messages necessary to operate your account (for example, OTP verification codes and approval status). Optional community alerts, event reminders, and announcements may be delivered by push notification, email, or SMS based on your preferences. You can manage notification preferences in the app at any time, and you may reply STOP to any text message to opt out of SMS. See our SMS Policy for full details.

The Acts of Love app is provided free of charge to parishioners. Parishes or organizations may enter separate written agreements with us for parish-level services. If we introduce any in-app purchase or subscription in the future, it will be presented with pricing, renewal terms, and cancellation instructions before you are charged, and purchases made through the Apple App Store or Google Play are also subject to that store's terms and refund policies.

The Service relies on third-party providers for hosting, SMS delivery, push notifications, and analytics. Your use of the Service may also involve your mobile carrier and app store. We are not responsible for third-party services, their availability, or their charges.

The Service, including its software, design, text, graphics, and the Acts of Love name and logo, is owned by Acts of Love or its licensors and is protected by intellectual property laws. We grant you a limited, personal, non-transferable, revocable license to use the app on devices you own or control for your personal, non-commercial community participation. You may not copy, modify, reverse engineer, distribute, or create derivative works from the Service except as permitted by law.

We may suspend or terminate your access at any time for violations of these Terms, for conduct harmful to the community, or if required by law or your parish. You may stop using the Service and request deletion of your account and associated data at any time in the app or by emailing support@actsofloveapp.com.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not screen members beyond parish administrator approval, and we do not guarantee the conduct of any member. Acts of Love does not provide medical, mental-health, legal, or emergency services. If you or someone else is in danger, contact 911 or local emergency services.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACTS OF LOVE AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, GOODWILL, OR PROFITS, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

These Terms are between you and Acts of Love only, not with Apple or Google. Apple and Google have no obligation to provide maintenance or support for the app. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); Apple has no other warranty obligation. Apple and Google are not responsible for addressing any claims relating to the app, including product liability, legal or regulatory compliance, or consumer protection claims, and are not responsible for investigating or resolving third-party intellectual property claims. Apple and Google are third-party beneficiaries of these Terms and may enforce them. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list.

You agree to indemnify and hold harmless Acts of Love from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Service, or your violation of these Terms or applicable law.

These Terms are governed by the laws of the State of Oklahoma, without regard to conflict-of-laws rules. You and Acts of Love agree to first attempt to resolve any dispute informally by contacting support@actsofloveapp.com. If a dispute is not resolved within 30 days, it will be brought exclusively in the state or federal courts located in Oklahoma County, Oklahoma, and both parties consent to that jurisdiction and venue.

We may update these Terms from time to time. We will update the "Last updated" date above and, for material changes, provide notice in the app or to the contact information associated with your account. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
